Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Pinellas Podcast LLC ("Pinellas Podcast," "we," "us," or "our"). Please read them carefully. If you don't agree, don't use the platform.

1. Your account

• You must be at least 13 years old to create an account.
• Provide accurate information and keep your login credentials secure.
• You're responsible for activity that happens under your account.
• We may suspend or terminate accounts that violate these Terms.

2. Acceptable use

When using the platform, you agree not to:

• Post content that is unlawful, hateful, harassing, defamatory, or infringing.
• Impersonate others or misrepresent your affiliation with a person or business.
• Attempt to game rewards, votes, check-ins, or leaderboards through fraud or automation.
• Scrape, disrupt, or attempt to gain unauthorized access to the platform.
• Upload malware or violate the privacy or rights of others.

3. User-generated content

• You retain ownership of content you submit (reviews, photos, comments, nominations, listings, recordings). You are responsible for it and confirm you have the rights to post it.
• You grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and promote your content on and in connection with the platform and our social channels.
• We may moderate, remove, or refuse content at our discretion, including content that violates these Terms. Copyright complaints are handled under our DMCA Policy.

4. The Explorer rewards program

Check-ins, points, badges, and offers are provided for fun and engagement. Rewards and member offers have no cash value, may change or end at any time, and are void where prohibited. Check-ins require being physically at a participating location; fraudulent check-ins may result in loss of points or account termination.

5. Business listings, subscriptions & billing

• Business listings are available on a free plan and paid plans (currently Pro at $24/month and Premium at $499/month). Prices are shown at checkout and may change with notice; changes take effect at your next renewal.
• Paid plans are billed through Stripe as recurring subscriptions that renew automatically each billing period until you cancel. By subscribing, you authorize us and Stripe to charge your payment method on each renewal date.
• Plan features unlock immediately after a successful payment. If a payment fails, we may retry the charge and may suspend paid features until payment succeeds.
• Cancellation: you can cancel any time from your business dashboard. Cancellation takes effect at the end of the current billing period — you keep paid access until that date, then the account drops to the Free plan. We do not provide partial or prorated refunds for the remainder of a billing period.
• Upgrades & downgrades: plan changes take effect at your next renewal date rather than immediately, and your next invoice reflects the new plan.
• Applicable sales tax is calculated and collected automatically at checkout based on your billing address.
• You're responsible for the accuracy and legality of your listings, offers, and any claims you make to customers.

6. Intellectual property

The platform, including its branding, design, and original content, is owned by Pinellas Podcast LLC and protected by intellectual property laws. You may not copy or reuse it without permission, except for content you submit.

7. Disclaimers

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We don't guarantee that content posted by users or businesses is accurate, and we're not responsible for interactions between users and businesses.

8. Limitation of liability

To the fullest extent permitted by law, Pinellas Podcast LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the platform. Our total liability for any claim will not exceed the greater of the amount you paid us in the prior twelve months or USD $100.

9. Dispute resolution & governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You agree that any dispute will be resolved in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction. Nothing here prevents either party from seeking injunctive relief.

10. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, provide additional notice. Continued use after changes means you accept the updated Terms.
